By accessing or using WASaaS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not use the Service.

2. Description of Service

WASaaS is a WhatsApp automation platform that enables businesses to manage contacts, send bulk campaigns, configure auto-replies, schedule messages, and integrate with third-party services via API and webhooks.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or messages in violation of WhatsApp's Terms of Service
• Transmit malware, viruses, or any harmful code
• Impersonate any person or entity
• Violate any applicable local, national, or international law
• Harvest or collect personal data of others without consent
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to any part of the Service

5. WhatsApp Compliance

You acknowledge that the Service operates through WhatsApp's platform. You are solely responsible for ensuring your use of the Service complies with WhatsApp's Terms of Service and policies. WASaaS is not affiliated with or endorsed by WhatsApp or Meta Platforms, Inc.

6. Subscription & Billing

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by WASaaS and is protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any data you submit through the Service.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, WASaaS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time from the settings page.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use after changes take effect constitutes acceptance.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.
